LOS ANGELES BUSINESSES TO FILE ANTI-TRUST SUIT AGAINST MANUFACTURER

(LegalLaw247.com, February 01, 2012 ) Los Angeles, CA -- Two local businesses have retained Los Angeles business litigation attorney Robert G. Klein to file an antitrust lawsuit against a large paint manufacturer and distributor. The complaint alleges breach of contract designed to protect local distributors and violations of the California Cartwright Act for restraints on trade that unfairly limits competition. Other issues raised in the lawsuit include exclusive dealing arrangements that are anti-competitive and refusals to deal. Mr. Klein is seeking a preliminary injunction to prevent what appears to be an unlawful agreement between two major players in the industry designed to eliminate the competition.

Robert G. Klein compared this case to the Morton Salt case often cited in pricing discrimination cases. He said, "Cases like these have their roots in a case involving Morton Salt, where the court essentially held that it was unfair for manufacturers and distributors to give large supermarket chains favored pricing based upon volume discounts that would essentially drive out the mom and pop grocers who had to pay higher prices per unit because they were unable to obtain the same pricing as the large chains."

Robert G. Klein, Esq. is a Los Angeles trademark attorney, business litigation attorney and a Los Angeles business lawyer. He specializes in trademark infringement, copyright infringement, business torts, breach of contract actions and unfair competition.

The California Cartwright Act is an antitrust law that restricts the cooperation of two or more persons skill, capital or actions to restrict trade and commerce, such as mandating price control or preventing competition. It is a more specific elaboration and expansion of the federal Sherman Act, which outlines unreasonable restraints that are in violation of antitrust law.
