Filings Of Viagra Melanoma Lawsuits Increase After Consolidation

On April 7, the U.S. Judicial Panel on Multidistrict Litigation approved a request by plaintiffs involved in Viagra skin cancer complaints to consolidate all cases filed in federal courts nationwide for pretrial proceedings. The judicial panel transferred 14 complaints pending in six courts to the U.S. District Court, Northern District of California where Judge Richard Seeborg will oversee the multidistrict litigation (MDL). The plaintiffs maintain that centralizing the Viagra melanoma lawsuits in a single federal court will help prevent duplicative discovery into common issues, avoid conflicting pretrial rulings from different courts, and serve the convenience of the parties, witnesses and the courts. Plaintiff also assert that consolidation is necessary since more cases are expected to be filed in the future. Viagra (sildenafil) is a medication prescribed to treat sexual dysfunction, including impotence, in men. Since receiving approval by the U.S. Food and Drug Administration in 1998, Pfizer’s blockbuster drug has been prescribed to an estimated 35 million patients and is considered by most to be an extremely safe medication. In 2013, Viagra held about 45 percent of the U.S. market share for erectile dysfunction medication. In addition, Pfizer reported $1.88 billion in global sales of Viagra in its 2013 annual report. However, studies have indicated that Viagra may cause skin cancer.

Study Shows Higher Risk Of Melanoma When Taking Viagra
In April 2014, a study was published in JAMA Internal Medicine suggesting that recent use of Viagra was “significantly associated” with a higher risk for melanoma. Researchers from Harvard Medical School used data on more than 25,000 patients who were followed for a decade. According to the analysis, men who took Viagra were 84 percent more likely to be diagnosed with melanoma compared to men who were not exposed to the drug.

Court documents indicate that Viagra melanoma lawsuits contend that Pfizer failed to use “due care” in designing, testing and manufacturing Viagra so as to avoid serious health risks. In a recently filed complaint, a Florida man said he began treatment for erectile dysfunction in January 2012. In April 2012, the plaintiff was diagnosed with melanoma and was “forced to undergo excision of the skin lesions in May 2012.
