Understanding The Immigration Process
(LegalLaw247.com, October 19, 2016 ) Santa Monica, CA -- In August 2016, the US Department of Homeland Security implemented a priority date for those applicants born in China or India from January 1, 2010. What this means is that these applicants would not be eligible to apply for the green cards for a number of years. Initially, the US Department of Homeland Security indicated that this measure was short-term, and the green card priority dates were expected to become current in October 2016. Fortunately, this has proven true.

When the August Visa Bulletin was issued, individuals born in India and China were facing an anticipated wait time of more than 6 years. However, in this case, the Department of State has indicated that the visa priority date was put in place in an attempt to hold the number of green cards issued to these two countries at the annual limit. This has only occurred twice in the history of the EB1 visa, and each time it has been temporary. The Visa Bulletin is a monthly report issued by the US Department of State that indicates when green cards controlled by statutory limitations will be available for issuance to prospective immigrants. The Visa Bulletin often contains both the current month and the upcoming month's versions.

According to the US Department of State, the bulletin summarizes the availability of immigrant numbers during October for "Final Action Dates" and "Dates for Filing Applications," indicating when immigrant visa applicants should be notified to assemble and submit required documentation to the National Visa Center.

Additionally, the US Department of State notes, "The Visa Bulletin provides projections for the Family and Employment categories that indicate what is likely to happen on a monthly basis through January based on current applicant demand patterns. Readers should never assume that recent trends in final action date movements are guaranteed for the future, or that 'corrective' action will not be required at some point in an effort maintain number use within the applicable annual limits. The determination of the actual monthly final action dates is subject to fluctuations in applicant demand and a number of other variables."

The Visa Bulletin is a resource for those citizens of those countries who are subject visa retrogression to determine approximately when they will be eligible to receive their green cards. Congress sets limits on the number of immigrant visas that can be issued each year, and the Visa Bulletin governs visa availability for those individuals who do not have an immediately available visa priority date.

Generally, the priority date is the date when the immigrant petition is properly filed with US Citizenship and Immigration Services (USCIS). With the priority date and the visa bulletin, an intending immigrant can get a general idea of when they will receive their green card. For example, a Chinese applicant who filed an EB2 on January 1, 2016, would have a priority date of January 1, 2016. According to the Visa Bulletin chart for EB2 applicants, USCIS is currently issuing green cards to applicants who have a priority date of January 1, 2010, or earlier. This shows us that the applicant will need to wait about 6 years before they are eligible to apply for a green card. This is just an estimate, however, it does serve as a useful guide to those candidates who are subject to visa retrogression.
