New York State’s ladder law, officially known as Labor Law 240, states that businesses and property owners are responsible for their facilities and are liable for any injuries that may occur on those premises, specifically referring to scaffolding and ladder accidents. With this new proposed amendment, workers would be guaranteed far less protection under the law in case of a workplace injury. Currently, New York is the only state to have such a legal safeguard for workers who sustain serious injuries on the job. However, tort reform advocates, backed by insurance company executives, want to make it easier for businesses and facilities to shirk their liability. The amendment’s supporters state that changing the law will help the courts avoid frivolous lawsuits and reduce the number of fraudulent injury claims. Wildstein disagrees, as do many union leaders and others who advocate for workers’ rights and protection.
“I am signing this petition because these proposed reforms will make it harder for injured workers to receive the help they need after an injury,” Wildstein said. “Working construction is a dangerous job, and this law protects workers by using the threat of money damages to pressure employers to keep their work sites as safe as possible.”
