• Injured parties must seek medical care within 14 days of the car accident to receive maximum reimbursement.
• Motorists injured in car accidents can only receive $2,500 in reimbursement, unless they suffer from an “emergency medical condition,” in which case they can receive up to $10,000.
• Only medical doctors, osteopathic physicians, dentists, physician assistants or advanced registered nurse practitioners can diagnose an “emergency medical condition.”
• The policies take effect on January 1, 2013.
• Massage therapists and acupuncturists can no longer receive reimbursement for therapy performed after a car accident.
• The insurer must pay your claim in 30 days. If the insurer suspects that your claim is fraudulent, it has an additional 60 days to review your claim. Insurers who fail to act within these 90 days are subject to sanctions under Florida’s Deceptive and Unfair Trade Practices Act (FDUTPA).
The Florida legislature implemented the new laws mainly to crack down on fraudulent insurance claims. Sarasota injury attorney Maria Gerber said that Floridians should not expect to see a decrease in their premiums.
“Unfortunately for consumers, the amendment does not require that individual premiums be reduced,” Gerber said. “While the law says that the insurance carriers must reduce PIP premiums by at least 25 percent by 2014, there is a loophole. If the insurance company can provide the Office of Insurance Regulation with a detailed excuse for not reducing premiums, they are off the hook. As such, it is not likely that Floridians will see lower premiums.”
