The case pertains to “gray goods” being sold in Japan in violation of an exclusive distribution right of the American as the exclusive licensee and the Japanese company that has an exclusive sublicense. Gray goods are defined as products or materials that would normally be unavailable or prohibitively expensive in a country. They can include products that would be unavailable in a particular country or sold for a much higher price in legal markets.
“We will seek an injunction to prevent the importation of these goods and for monetary damages still to be determined,” Klein said. “The producers of these goods have the right to distribute their product, and gray market actions are a direct infringement of that right.”
