The ADA requires that employers take into account whether a job accommodation, such as transfer to another position, would allow a disabled worker to keep their job. It has been suggested that Maximum Leave Policies that lack exceptions may violate the ADA, and that employers cannot terminate disabled employees who needed time away from work simply by imposing these policies. Employers may be required to take further steps to accommodate disabled employees and ensure they can continue employment with the company; these steps may include reasonable accommodations or additional leave, so long as this does not create undue hardship for the employer.
