Statistics on Same-Sex Divorce Stay Stagnant

(LegalLaw247.com, May 28, 2013 ) Albuquerque, NM -- Among the US states that have legalized gay marriage, there is very little data that exists to compare divorced rates for same sex marriages to divorced rates for heterosexual marriages. There are a variety of reasons why there is lacking data, of course.

The dissolution of marriage does not necessarily capture the genders of the parties involved. Even the forms that differentiate between dissolution of marriage and dissolution of domestic partnership do not report whether the parties are male or female or both of the same gender.

New Hampshire has some extensive data on divorce, but even if officials there can’t calculate same sex marriage divorce rates because a couple could be married out of state and live in New Hampshire. Or another couple could get married in New Hampshire but get divorced in another state.

Also, same-sex marriage is quite new to the United States, and there are very few states who even legally recognize it as marriage, so it hasn’t been around long enough to be able to track the way heterosexual marriage in a reliable way.

The federal government collects divorce statistics from for heterosexual marriages, but it doesn’t collect the same data from same-sex couples to be able to determine the chance of homosexual marriages that will end in divorce.
