Federal Talcum Powder Lawsuits, Others Pending in California Superior Court, May Be Centralized, Southern Med Law Reports

(LegalLaw247.com, August 02, 2016 ) Talcum powder lawsuit plaintiffs pursing ovarian cancer claims against Johnson & Johnson are seeking centralization of cases filed in federal courts, as well as any pending in California Superior Court, Southern Med Law Reports. On July 15th, a Motion for Transfer was filed with the U.S. Judicial Panel on Multidistrict Litigation (JPML) requesting that federal cases involving Johnson & Johnson be transferred to the U.S. District Court, Southern District of Illinois, for the purposes of coordinated pretrial proceedings. The Motion notes that at least 11 talcum powder lawsuits have already been filed in various federal jurisdictions on behalf of women who allegedly developed ovarian cancer due to their use of Johnson & Johnson’s Baby Powder and/or Shower-to-Shower for feminine hygiene purposes. In May, talcum powder lawsuit plaintiffs in California filed a Petition for Coordination with the state’s Chair of the Judicial Council. According to the initial petition, only four talc powder lawsuits were pending in the state. However, on June 28th, a Notice of Potential Add-On Actions was filed on behalf of more than a dozen additional plaintiffs. A hearing on the matter has been scheduled for July 29th in Los Angeles Superior Court, the proposed venue for the coordinated docket. (JCCP 4872)

Court records indicate that Johnson & Johnson has been named a defendant in more than 1,200 talcum powder lawsuits nationwide. Cases filed in Missouri’s St. Louis Circuit Court are already undergoing coordinated proceedings. Additional lawsuits pending in New Jersey have been centralized in a multicounty litigation now underway in Atlantic County Superior Court. Plaintiffs claim that Johnson & Johnson has concealed evidence linking the regular, repeated genital application of talc-powders to the development of ovarian cancer, and has failed to provide any warnings about this alleged risk in order to protect profits earned from its Baby Powder and Shower-to-Shower franchises. Among other things, plaintiffs cite numerous studies dating back to the 1970s which suggested that women who used talcum powder as a regular part of their daily feminine hygiene routine were more likely to develop ovarian cancer.

Court records indicate that the Missouri litigation has already convened two talcum powder lawsuit trials in St. Louis. The first concluded in February, after $72 million in compensatory and punitive damages was awarded to the family of an ovarian cancer victim who died after using Johnson & Johnson talc powders for more than three decades. In April, jurors hearing another case ordered the company to pay $55 million to a South Dakota ovarian cancer victim who had also applied Johnson & Johnson talcum powders to the genital region on a regular, long-term basis.
